AbsolutEmails End User License Agreement
Effective October 30, 2026
AbsolutEmails ("AE") is a dealership communication platform provided by Nomad Innovative Technologies LLC ("NIT," "we," or "us"). By selecting "I agree" you accept this agreement for your own use of AE. Your personal acceptance does not sign a dealership subscription agreement or authorize a payment.
1. Your access and licensed location
We grant you a limited, nonexclusive, nontransferable right to use AE for your authorized dealership location and department while access is permitted under its subscription. Each person must use an individual login. Keep credentials and private links confidential, use accurate identity information, and promptly report suspected unauthorized access to support@absolutemails.com.
Your customer master controls the location's approved template library and shared dealership details. You may not change your organization, misstate an address, share a login, or add people from an unlicensed location or department to avoid a separate subscription. Fleet and Customer Relations are separate department customers. Explicit contact-book sharing does not transfer a license or grant access to another department.
2. Templates, technology and ownership
AE uses Dealer EFX template technology. NIT and its licensors retain their rights in supplied software, templates, artwork, copy, layouts, tools, technology and NIT-created customizations. These materials are licensed, not sold; subscription, setup or customization fees transfer no ownership. Your dealership and other rights holders retain their rights in their own data, branding and supplied materials.
You may personalize approved templates and use them for authorized dealership customer communications. Except where applicable law prevents a restriction, you may not resell, sublicense, share with unlicensed locations, independently reuse supplied materials for another provider, reverse engineer the software, derive a competing product from NIT materials, or remove proprietary notices. When access ends, stop active use of licensed materials. Previously sent communications and inactive backups may remain as records, not reusable templates.
3. Customer data and sharing
Enter or upload information only when you have authority and a legitimate business purpose. Contacts are shared with authorized users in the same location and department. A customer master can expressly give other stores in the same verified dealer group and department access to view, use, add and edit its contact book. Shared-book access is direct, can be revoked, and does not automatically share personal follow-ups or sent-email history. Other quote or team sharing features follow their separate permissions.
Use designated insurance-document features only for authorized business insurance records needed for the transaction. Do not upload Social Security numbers, payment-card or bank-account credentials, government identity documents, medical records, credit reports or unrelated sensitive data. Obtain necessary permissions for other people's information and for materials you supply. You authorize NIT to host, process, transmit, protect and back up submitted data to operate and support AE.
4. Lawful communication and acceptable use
You are responsible for recipients, the legal basis for your communications, accurate sender and subject information, required advertising and postal-address disclosures, honoring opt-out requests, and applicable privacy, consent, anti-spam and advertising requirements. Do not send spam, phishing, deceptive or unlawful content; impersonate others; scrape private records; bypass permissions; or disrupt the service. An available template or contact address is not permission to contact someone.
5. Review before sending
Review every message, attachment, vehicle description, price, quote, calculation, offer and disclosure before use. Verify source data and time-sensitive information. AE's tools are assistance, not legal, tax, accounting, financing or compliance advice. No delivery, inbox placement, lead, sale or financial result is guaranteed. Sending through a configured third-party provider is also subject to that provider's terms.
6. Security, links and availability
We use safeguards designed to protect AE, but cannot guarantee perfect security or uninterrupted availability. Authorized support staff may use audited or controlled account access to support the service. Some published artwork, delivered attachments or intentionally shared pages are accessible by link; recipients may retain copies. Share links carefully. Third-party sites, hosting, email providers and OEM resources have their own practices and availability.
7. Restrictions and termination
We may restrict access when reasonably necessary to address security risks, unlawful conduct, misuse or a subscription ending. Your dealership may also remove your access. Stopping your personal use does not cancel the dealership subscription. Contact your master or support for access and data requests; applicable retention obligations and other authorized users' records may remain.
8. Disclaimers and liability
To the extent permitted by law, AE is provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose or noninfringement. To that extent, NIT is not liable for indirect, incidental, consequential or lost-profit damages arising from use of AE. A signed dealership agreement governs its negotiated commercial terms and liability provisions. Nothing here limits rights or liability that applicable law does not allow to be limited.
9. Updates and contact
Material updates may require you to review and accept a new version before continuing. We keep the version and acceptance record. The Privacy Notice explains how AE handles information; acknowledging it does not waive privacy rights or give marketing consent. Wyoming law governs this agreement except where mandatory applicable law requires otherwise. Questions: support@absolutemails.com.
